Dennis D. Miller has represented major financial institutions, leasing companies and landlords in commercial bankruptcy cases and federal and state court litigation for over 20 years. Mr. Miller specializes in representing financial institutions involving real and personal property secured transactions in both chapter 11 bankruptcy cases and commercial litigation. In the areas of California real estate law, Mr. Miller has extensive experience in judicial and non-judicial foreclosures, the appointment of receivers and construction litigation. He also has extensive experience in pre- and post-judgment remedies and has lectured on the enforcement of judgments in California.

Mr. Miller has represented clients in the bankruptcy courts in New York, Delaware, California, Nevada, Arizona and Illinois. In commercial litigation, he has represented clients in the California state courts and the federal courts in the Northern and Central Districts of California. He has successfully argued appeals before the Court of Appeals for the Ninth Circuit and the Bankruptcy Appellate Panel for the Ninth Circuit, and was a judicial extern for the Honorable John A. Arguelles of the California Supreme Court.

Mr. Miller is also a private mediator and has served as a mediator for the Bankruptcy Dispute Resolution Panel for the United States Bankruptcy Court for the Northern District of California for more than six years. He has also served as a judge pro tem in pre-trial and settlement conferences for the Marin County Superior Court.   Mr. Miller was recently President of the California Receivers Forum-Bay Area Chapter and is now Vice-President of the Bay Area Bankruptcy Forum as well as serving on the Board of Directors of both organizations.

In 2006, Mr. Miller was named one of the Top Lawyers in the Bay Area in Bankruptcy.  In 2010, Mr. Miller was named to the Northern California Super Lawyers in Bankruptcy & Creditor/Debtor Rights.

Mr. Miller earned a B.S. in Chemistry and a B.A. in Biology in from the University of California, Irvine in 1978, a Ph.D. in Chemistry from Cornell University in 1983, and a J.D. from the University of San Francisco School of Law in 1988.


Representative Matters

  • Successfully defended General Electric Capital Corporation in a multi-million dollar lender liability action by obtaining a summary judgment in the Orange County Superior Court.
  • Successfully defended a lender client in a wrongful foreclosure action where the borrower sought damages in excess of $5 million.

  • Successfully represented a floor financing lender through plan confirmation on a Chapter 11 case in the Arizona Bankruptcy Court with over $35 million at issue.
